NETTICA ACCEPTABLE USE POLICY

Nettica reserves the right to suspend or terminate your account for violations of our acceptable use policy.

ABUSE

You may not use Nettica's network and/or services to:

Engage in the distribution of unsolicited commercial email/unsolicited bulk email ("spam").

Control "zombie" networks to infect, or attempt to infect computers with viruses, spyware, malware, or issue denial of service attacks upon any domain, domains, IP address, or addresses.

Host or promote child pornography.

Promote or incite violence, threaten violence, or host websites containing harrassing content or hate speech.

Host sites for organizations or governments that are terrorist organizations, or sponsor terrorist organizations, as listed by the United States, United Kingdom, European Union, or other major International Body.

Host or promote sites that infringes upon another's copyright, trade or service mark, patent or other proprietary right, including but not limited to: illegal music, video, or software downloads.

Host sites that are malicious or fraudulent, or engage in any other illegal activity.

Cause our services or IP addresses to become "blacklisted" by real-time blacklist services such as SORBS, Spamhaus.org, or SpamCop.

Any use or misuse of our services that interferes with the normal working operation of our systems, including, but not limited to, excessive API calls, excessive DNS records, time-to-live DNS values that generate excessive queries, polling mechanisms, excessive URL forwards requests, or any other use or activity that intereferes with normal operations.

CONSEQUENCES

Nettica may, with or without notice, suspend or terminate service for domains or accounts found in violation of this AUP. We may take whatever actions are necessary to preserve the integrity of our service or network, including adjusting DNS records, removing service, "null routing" requests, or any other measure deemed appropriate.

Account holders are responsible for any violations of this AUP, including violations by their customers, affiliates, and including violations caused by the misconfiguration or unauthoritized use of their servers or services.

We reserve the right to collect reimbursement for our time to investigate and remedy abuse complaints at our regular fee of $200.00/hour, as well as any other fees incurred from third parties to resolve the issue.

AMENDMENTS

From time to time we may amend or clarify this agreement. By using Nettica services you agree to be bound by this acceptable use policy. If you do not agree with this policy, contact support and we will terminate your service.

DISCLAIMER

Nettica is under no duty, and is not obligated by this AUP to undertake a duty, to monitor or police our customer's activities, and disclaims any responsibility for the use or misuse or Nettica's network or services. Nettica disclaims any obligations to any person or legal entity that has not entered into an agreement with Nettica for services.
